We store a digital version of your photos to offer the Services to you, please refer to our privacy policy for more details. We recommend you keep backup copies of all your digital data. We decline liability for loss of your images or the digital version of your photobooks or pictures. Any claims for compensation of costs incurred in taking the photos or compensation of sentimental value are waived.

11. Data Protection:

We care about the privacy of our Users and do not share or sell your data for marketing purposes. You understand that by using the Services you consent to the collection, use and disclosure of your data and aggregate data as set forth in our Privacy Policy.

12. Copyright:

You are solely responsible for the contents of data submitted to Binding Ties. You have to ensure that you are entitled to all copyright, trademark or other rights for the images transferred to us. You alone will bear consequences stemming from a possible infringement of those rights. Should any third parties assert any claims against Binding Ties in connection with your order on the basis of an infringement of copyrights, trademarks or other rights, you will be liable to ward off these claims at your expense and to indemnify Binding Ties for any and all damages incurred.

13. Submission of Content:

You affirm you have the consent of each and every identifiable person in the User Content to use such person’s name or photographs in use of the Service and Agreement, and each such person has released Binding Ties from any liability that may arise in relation to such use. Binding Ties also reserves the right to reject Submissions which contain Prohibited Content. Prohibited content would include: (a) Submissions which could infringe copyrights or other intellectual property rights of any third party; (b) Any Submissions which are threatening, defamatory, obscene, pornographic or otherwise inappropriate or could give rise to any civil or criminal liability under applicable law; (c) Any Submissions which contain viruses, worms or harmful code; (d) Any Submission that promote any illegal or harmful activity. Determination as to where a Submission contains prohibited content is solely at Binding Ties’ discretion.

14. Right of Use:

By submitting your data, you grant Binding Ties and its associates the right to copy, modify, transmit and use your data to provide you with your ordered Products and to provide the Service.

15. Promotional Offers:

From time to time, Binding Ties may offer special discounts as promotional offers. Each offer is subject to the offer details included in the offer and for the time period noted. If there are multiple offers valid at any given time, only one valid offer can be applied to a particular order and may not be combined with other offers in the same order. The discount codes must be applied on the site and at the time of check-out; they cannot be applied to orders that have been previously submitted. The offers have no cash value and hence are not redeemable for cash or refunds.

16. Gift Cards:

Binding Ties gift cards (also called gift vouchers) can only be purchased and redeemed through the Website www.bindingties.in using an active account. Purchasing or using gift cards establishes acceptance of these Terms. Gift cards are non-refundable, non-transferable and not redeemable for cash or any other vouchers or codes. Risk of Loss: The risk of loss and title for Gift Cards pass to the purchaser upon purchase. Binding Ties is not responsible if any Gift Card is lost, stolen, destroyed or used without your permission. If we believe that a Gift Card is used, redeemed or obtained fraudulently, Binding Ties reserves the right to reject the redemption or use of the gift card, bill alternative forms of payment, and/or take available legal actions. Each gift card is valid for one time use only, and can only be used for a single transaction at www.bindingties.in. If a transaction exceeds the value stated, the customer will be required to pay any additional amount in order to complete said transaction. If a transaction is less than the value stated, the customer forfeits any balance not used, and no credit or cash will be owed.
